The following Rules shall govern the use and occupancy of the community areas and units comprising the project designated "Vista del Lido", and shall apply with equal force to all owners, residents, lessees, tenants, occupants, guests, workers, and any others occupying or using the premises.
 
The Board of Directors reserves the right to make such rules and regulations from time to time as may be deemed needful for the safety, care, and cleanliness of the premises and for the securing of comfort and convenience of all occupants thereof.
 
These House Rules do not supersede or change the By-Laws or Covenants, Conditions and Restrictions (CC&R's) in any manner but are in addition to said By-Laws and CC&R's. They do have the same status of law and enforceability.

GENERAL COMMUNITY RULES

   

1.

All homeowners shall be responsible for the adherence of their guests, employees, agents, licensees, tenants, and contractors to the Vista del Lido Rules.

 

 

ANY RULES VIOLATION 

WILL RESULT IN A FINE OR ASSESSMENT.

 

2.

Smoking of any type is prohibited in all common areas of the Vista del Lido property including Elevators, Patios, Balconies, Exterior Rear Patio, Barbeque, Pool, Boat Docks, and Front Parking Areas.

 

3.

Do Not Obstruct – Community Hallways, Sidewalks, Stairwells, Drives, and Elevators shall not be obstructed or used for any other purposes than for entering and exiting from the units. This is an important safety concern.

 

4.

Storing Your Items in Stairwells, Electrical Closets, or Other Common AreasNo personal items are to be stored in the emergency fire stairwells, electrical closets, or other common areas. The Building Superintendent will collect all illegally stored items and hold for a period of two (2) weeks, and if left unclaimed, they will be treated as abandoned property subject to disposition pursuant to California Law.

 

5. All usual Garbage and Trash shall be deposited into the Trash Chute. All Raw Garbage not suitable for disposals should be TIGHTLY baggedNever shall Construction Debris or anything large (e.g. pizza boxes, hangers), which might become stuck, be thrown down Trash Chutes. Recycling containers in trash areas are to be used for newspapers, glass, and aluminum cans. DO NOT leave items, which do not fit into the chute in the hall closet; take them down to the lower-level trash room.

 

6.

NO DELIVERIES THROUGH THE LOBBY except those, which are carried by hand (i.e. UPS, Fed Ex, Amazon, etc.).  All other deliveries MUST be made through the garage level.

 

7.

Large Deliveries – Residents receiving large deliveries shall first notify the Building Superintendent and arrange with him for delivery date(s).  An elevator must be properly padded for such deliveries. Elevator padding is usually stored in the hallway electric/phone closet on second floor.  Large items constitute any item too heavy or bulky to be carried by hand and/or odd-shaped, which will not fit easily in elevators.

 

8.

Waterbeds are not permitted.

 

9.

Shopping CartsGray Metal Shopping Carts near mailroom door are for use by residents only and are not for construction materials. Blue Plastic Shopping Carts stored in the garage trash room are for larger loads, tools, or construction materials.  Construction workers may use the Blue Carts. Moving companies are not permitted use of the carts.  Carts must be returned to the garage after use and must not be left in elevators, hallways, stairways, units, or mail room.

 

10.

Lost Laundry – Articles of clothing left unclaimed in the laundry room for a period of three (3) days shall be considered abandoned property subject to disposition pursuant to California Law.

 

11.

Utilities shall not be left running any unreasonable or unnecessary length of time in the resident unit.

 

12.

Common Area Lighting – No resident shall interfere in any manner with any portion of the lighting apparatuses in or about the common area.

 

13.

Neighborly Noise – No resident shall make or permit any disturbing noises in the building by themselves, their family, guests, or workers, nor do or permit, anything to be done by such persons that will interfere with the rights, comforts, and convenience of other occupants of the building.

 

14.

Children shall not be permitted to loiter or play on stairways, hallways, lobby, or elevators.

 

15.

Bicycle, Skates, and Skateboard use is prohibited in the lobby, garage, patio, parking, or any common area. Bicycles may be stored in the garage and, for safety, should be walked on/off the property.

 

16.

No Parking Areas – No vehicle shall be parked where "NO PARKING" signs are posted. Vista del Lido Condominium Association reserves the right to tow offending vehicles without warning.

 

17.

Storing Personal Items in Garage Parking Spaces is not allowed.  Vehicles and bicycles only.

 

18.

No Automobile Washing/Waxing or Maintenance Repair is allowed in community areas. 

 

19.

Painting or Spray Painting – No painting or spray painting by or for a resident is allowed in any common areas, community hallways, sidewalks, stairways, or drives. Any damage from misuse of any nature or character whatever shall be paid for by the resident responsible for said damage.

 

20.

No Flammable Oils or Fluids such as gasoline, kerosene, naphtha, or benzene or any other explosives or articles deemed extra hazardous to life, limb, or property shall be stored in common areas, including designated parking spaces for residents. Each resident is responsible for knowing the fire code and adhering to same.

 

21.

Nothing shall be thrown or emptied out of the windows or doors, or down the passages, balconies, or in the building areas by residents, their guests, or their workers.

 

22.

Sweeping Dirt / Beating Rugs, etc. – No rugs shall be beaten on the balconies or terraces, nor shall dust, rubbish, or litter be swept from any of the balconies, resident units, or any room thereof into any of the halls or entryways of the building containing said premises. The occupant responsible for said damage shall pay for any damage from misuse of any nature or character whatsoever.

 

23.

Balcony Furniture/Décor – No large items of furniture or decoration shall be stored or hung from the balconies. No patio/lawn umbrellas are permitted on balconies. Any plantings within the balconies, which are visible from the exterior, must be kept in good condition.

 

24.

Holiday Décor – No sign, signal, illumination, or decoration shall be installed or imposed on any window, door, or other part of the common areas except for holiday decorations from Thanksgiving Weekend to January 15 and all such decorations shall be subject to the approval by the Board of Directors.

 

25.

Nothing shall be hung from the outside of the windows or balconies including but not limited to towels, bathing suits, wetsuits, laundry, banners, and any flags other than the United States flag.

 

26.

No Exterior Shades, Awnings, or Window Treatment Coatings shall be used except those installed by or approved by the Board of Directors. The type and color of all exposed window coverings shall be subject to Board approval.

 

27.

Antennas – No outside radio or television antenna connection shall be installed by the resident outside of their respective unit or on any common area.

 

28.

Roof Access – No resident or guest will have access to the roof.

 

29.

Spills on Common Area Carpet, Furniture, Wallpaper, etc. – 

Do NOT attempt to clean carpets, furniture, or wallpaper, etc. in common areas. Notify the Building Superintendent as quickly as possible.

 

30.

Barbecue Curfew for barbecuing shall be 9:30 PM. Users MUST CLEAN the barbecue and surrounding area after each use as a courtesy to other residents.  No barbecuing is allowed on resident balconies.

 

31.

Reserve the Patio – (see attached "Patio Reservations Guidelines")

Owners wishing to reserve the lobby patio area shall notify the Building Superintendent and deposit a $250.00 sum, payable to Vista del Lido. The Building Superintendent will post a notice within a reasonable amount of time on the board located in the mailroom. Said sum shall remain in the custody of the Building Superintendent until refunded, should no damage occur.  If damage exceeds $250.00, a special assessment will be imposed on the homeowner or lessee responsible.

Patio Hours for Reserved Use are:
Sunday through Thursday when curfew shall be 10:00 PM and
Friday and Saturday when curfew shall be 11:00 PM.  

The noise level shall be kept consistent with residential use and shall not unreasonably disturb other residents.

 

32.

Patio during Holidays & Boat Parade – No resident shall reserve the patio for their exclusive use on major holidays or during the days that the Holiday Boat Parade passes by the property. The patio should be available for all residents' enjoyment at these times.

 

33.

Owners Leasing Out Their Units must supply the name(s) of the prospective tenants to the Building Superintendent. The Building Superintendent will distribute to all new tenants the Vista del Lido Condominium Association Information Packet including the House Rules.

 

34.

Month-to-Month Rentals are NOT PERMITTEDAll leases must be a minimum of twelve (12) months.

 

35.

Real Estate BROKER PREVIEW – Broker Preview for real estate companies and agents is permitted on Friday between the hours of 10:00 AM to 2:30 PM. No owner or real estate agent will be permitted to leave open any common area doors or gates to the building during this time.

 

36.

Real Estate OPEN HOUSE – Owners wishing to sell their units may hold Open House to the public between 1:00 PM and 5:00 PM on Saturday and Sunday only. No owner or real estate agent will be permitted to leave open any common area doors or gate to the building during this time.

 

37.

Lock Boxes are not permitted.

 

38.

No Brochures or Pamphlets are to be distributed door to door.  Owners who wish to sell or rent their units may contact the Building Superintendent and request that information pertaining to their units be listed on the Notice Board located inside the mailroom entrance.

 

39.

Notice Boards – Vista del Lido shall maintain two (2) Notice Boards in the mail room area. One will be used exclusively for Board of Directors' official notices, etc. The other shall be for the use of any homeowner or lessee to post general notices.  Please check with the Building Superintendent to post notices on the Public Board.

 

40.

Nameplates, etc. – Occupants will not be allowed to put their names in any place except the mailbox and directory provided for their use.

 

41.

Pets are allowed with the following restrictions: One (1) pet per unit.  A deposit of $250.00 is required and an owner must sign a Pet Waiver. A LEASH IS REQUIRED for pet(s) that enter COMMON AREAS or must always be kept under control. All pet waste is the responsibility of the pet’s owner.  Owner shall be liable for any unreasonable noise or damage to person or property caused by any animal. Allowable pets include ordinary domesticated dogs, cats, birds (inside bird cages), and aquatic animals in an aquarium. No animals, livestock, reptiles, insects, poultry, or other animals of any kind shall be kept in any residence.

 

42.

Emergency Keys for each unit are maintained by the Building Superintendent and the President of the Vista del Lido Condominium Association. In the instance where an emergency key is not on file with the Building Superintendent and an emergency occurs within said unit, forced entry shall be made and all damages relating to the forced entry will be the responsibility of the homeowner.

 

43.

The Building Superintendent and the Maintenance Supervisor maintain and service the building premises and are not permitted to do work inside units during normal working hours except in an emergency. The Vista del Lido Condominium Association is neither liable nor responsible for any work in any unit performed by the Building Superintendent or the Maintenance Supervisor, which is not a part of their job description for Vista del Lido.

 

44.

Variances – The Board of Directors shall have the authority to grant variances of these Rules on a case-by-case basis for good cause shown.  Any waiver or variance of these Rules should not be deemed a waiver of the Rules in any other case. 



RULES FOR MOVING IN AND OUT

   

1.

Anyone moving in or out of the Vista del Lido building MUST arrange the dates and times with the Building Superintendent. 

No one will be allowed to move into or out of the building without first contacting the Building Superintendent to schedule the move.

 

2.

A $250.00 non-refundable move-in fee is required from all new owners and tenants.

 

3.

A $1,000.00 damage deposit, payable to Vista del Lido will be required before move-in or out.  Said deposit shall remain in the custody of the Building Superintendent until refunded, should no damage occur.  If damage is over $1,000.00, a special assessment will be imposed on the homeowner or tenant responsible.

 

4. Moving in and out will be permitted through the Garage Entrance ONLYNO moving in or out shall be permitted through the Lobby. Anyone moving large items through the lobby will be fined pursuant to the fine/penalty schedule made a part of these Rules.

 

5.

Proper elevator padding is required before moving. No large items are permitted in unpadded elevators.  Elevator padding is usually stored in the hallway electric/phone closet on the second floor.

 

6.

Hours for Moving are: 8:00 AM to 5:00 PM Monday through Saturday prearranged with the Building Superintendent.  NEVER ON SUNDAY.

 

7.

Cardboard moving boxes are to be discarded in the main trash room located on garage level.  Please break down (flatten) the boxes.  No cardboard boxes large enough to get stuck are permitted down the trash chutes. 

 


SWIMMING POOL AREA RULES

   

1.

The swimming pool and swimming pool areas are for the use of owners, lessees, and their invited guests ONLY.

 

2.

All Guests must be accompanied by a resident adult at all times.

 

3.

Residents are responsible for the conduct of their guests at all times.

 

4. Children and adolescents under the age of 14 years must be accompanied and supervised at all times by the adult responsible for them.

 

5.

No children wearing diapers will be allowed in the pool or spa.

 

6.

No boisterous or rough play is permitted in the pool or in the pool area.

 

7.

No loud music or offensive activity that would interfere with the rights of quiet enjoyment of the residents shall take place in or around the pool area.

 

8.

Footwear and Cover-Ups ARE REQUIRED for entering or leaving the pool area.  No bare feet through the Lobby.  No resident will be permitted to sit on any lobby furniture in wet clothes.  Any damage to carpeting or furniture due to violating this Rule will be billed to the person(s) responsible.

 

9.

The use of glassware or glass bottles in the pool area is prohibited.

 

10.

No pool furniture is allowed in the pool.

 

11.

NO PETS are allowed in the pool area.  No pets are allowed in swimming pool or spa due to public health laws.  If you require the assistance of a service animal, speak with the Building Superintendent prior to entering the pool area. 

 


BARBEQUE AREA RULES

   

1.

Barbecuing shall be done in the prescribed area.  No barbecuing shall be allowed on resident balconies.

 

2.

It is the responsibility of each resident to properly clean up the BBQ area after each use as a courtesy to other residents.

 

3.

Curfew for barbecuing shall be 9:30 PM. 

 


PATIO RESERVATION GUIDLINES

   

1.

Any homeowner reserving the patio will deposit $250.00 with the Building Superintendent.  The deposit will be refunded if the premises are left in a clean and orderly condition.

 

2.

Vista del Lido staff will assist the homeowner who is reserving the patio with the distribution of the tables and chairs.  These will be in a clean condition.

 

3.

After the Party/Event is over:


a. Trash should be neatly bagged and placed in the containers provided on the patio.


b. Tables and chairs should be stacked by the storage area in the patio for Vista del Lido staff to put away on the first regular workday.


c. The general area should be left in an acceptably clean condition so that other residents may enjoy the use of the patio area later.


d. Cleanup should be accomplished by 9:00 AM on the morning following the evening of a party or within two hours of the ending of a daytime party. 


 

FAILURE TO ABIDE BY THESE RULES WILL RESULT IN FINES
AND/OR A FORFEITURE OF ALL OR PART OF THE DEPOSIT

FIRST VIOLATION            $ 100.00

 

SECOND VIOLATION        $ 200.00

 

THIRD VIOLATION           $ 400.00

 

FOURTH VIOLATION         $ 600.00

 

The above schedule is intended as a guideline to assist the Association in the enforcement of the Declaration of Covenants, Conditions and Restrictions (CC&R's) and the House Rules as adopted from time to time by the Board of Directors.  However, the Board reserves the discretionary right to deviate from the above schedule depending upon the individual circumstances.
